TERMS AND CONDITIONS Participation in the Kartoffel Geflüster promotion, hereinafter referred to as "Organizer," is exclusively governed by these terms and conditions. Participation in the promotion is free of charge.

By participating in the promotion, each participant agrees to these terms and conditions.

1. Organizer

The promotion is organized by GbR: Laub, Niclas Torben / Schultheis, Hendrik, with registered office at Oranienstraße 32A, 65185 Wiesbaden, Germany. 2. Promotion Period

The promotion begins on Nov 3, 2025, 11:00 pm and ends on Dec 20, 2025, 11:00 pm. Participation is only possible within this period.

3. Eligibility

All natural persons who have reached the age of 18 and reside in Germany are eligible to participate in the promotion. Employees of the Organizer and their family members living in the same household are excluded from participation.

All information provided by the participant must be truthful and relate exclusively to the participant. Providing false information will automatically lead to exclusion from the promotion.

Each participant may only participate with one registration (cf. Section 4). Multiple registrations with the same (full or partial) participant information will lead to the exclusion of the participant from the promotion.

Actions that deviate from natural usage behavior (e.g., systematic participation with multiple email addresses) will also lead to automatic exclusion from the promotion.

4. Participation Requirements and Promotion Procedure

To participate, participants must register with their email address on www.kartoffelgefluester.de. By registering, the participant agrees that the Organizer may send them newsletters (see Section 7 a)).

With registration, each participant collects one point for the raffle and is thus represented once in the winner drawing (cf. Section 5 b)). Participants can collect additional points by performing certain actions displayed on the sweepstakes page. These can include, for example: uploading/providing a product review, following the Organizer on social media, or purchasing a product via a special promotional link. The number of points awarded for performing an action varies depending on the action.

Following on TikTok collects another point.

Furthermore, participants can collect points by purchasing products on https://www.kartoffelgefluester.de/. The purchase value in whole Euros corresponds to the number of points (1 EUR = 1 point). To ensure the purchase is credited to the sweepstakes, the word "XMAS2025" must be entered at checkout.

The more points a participant collects, the more often they are represented in the winner drawing and the higher their chance of being drawn as a winner (see Section 5 b)).

Note: Participation is free of charge. Even if a purchase is required for some actions, there are alternative free ways for all participants to collect the maximum possible number of points. The maximum number of additional points is limited to 125,000.

5. Prize / Determination of Winner / Notification and Handover of Prize

a) Prize

The prize is a Wunschgutschein (gift voucher) with a market value of approx. 1500 EUR.

b) Winner Determination

The winner will be determined by a random drawing among all participants, with participants being represented in the drawing according to the number of points they have collected. For example, if a participant has collected 100 points, they will be represented 100 times in the drawing.

The (first) drawing will take place on December 20, 2025.

c) Notification

The drawn participant will be immediately informed of their drawing via the email address and/or phone number provided during registration. Participants must ensure that they can be reached via the provided contact details.

If the Organizer cannot reach the drawn participant and the participant does not contact the Organizer within 14 days of being notified of their drawing, the Organizer is entitled to draw another participant in a further drawing.

As soon as the Organizer reaches the drawn participant, they will verify whether the drawn participant fulfills all conditions specified in these terms and conditions (including the cooperation rules under Section 7. a) and b)). Only then will they be confirmed as the winner.

The above procedure applies to all further drawings until a winner has been determined.

d) Handover of the Prize

The prize will be handed over exclusively to the winner. The handover will take place in Wiesbaden, Germany. Further information will be communicated directly to the winner.

Please note: The Organizer does not cover travel costs (e.g., travel to Wiesbaden and accommodation) incurred for the prize handover. These must be borne by the winner.

The winner is responsible for any necessary and incurred taxation of the prize.

e) Limitation of Liability

The Organizer is only liable for intent and gross negligence. For slight negligence, the Organizer is only liable for the violation of essential contractual obligations. Liability is limited to foreseeable damages. These limitations do not apply in case of injury to life, body, or health.

6. Other Provisions

a) Restrictions

The prize is neither transferable nor assignable. An exchange or cash payment is excluded. The Organizer reserves the right to replace the prize with a prize of equal or higher value.

b) Amendment of Terms and Conditions

The Organizer reserves the right to make adjustments to the terms and conditions.

c) Exclusion of Participants

The Organizer is entitled to exclude participants from participation or from winning in case of a violation of these terms and conditions or in case of suspected manipulation or other fraudulent behavior. This includes, for example, attempts to influence the participation process, such as by disrupting the process, multiple registrations, etc. If the conditions for exclusion from participation are met, the Organizer is also entitled to reclaim any awarded prize. In such cases, the Organizer also reserves the right to take further legal action.

d) Early Termination

The Organizer reserves the right to modify, suspend, cancel or terminate the promotion at any time without prior notice and without giving reasons, if the implementation and/or execution of the promotion cannot be guaranteed for legal and/or factual reasons, especially if there is suspicion of manipulation. In such a case, participants shall not be entitled to any claims against the Organizer.

e) Exclusion of Legal Recourse

Legal recourse is excluded for the execution of the promotion, the prize decision, and the granting of the prize.

7. Data Protection

a) Processing of Personal Data

To participate in the promotion, the Organizer collects personal data of the participants via the registration form. This includes name, email address, and other voluntarily provided data, e.g., address or telephone number.

The Organizer processes this personal data exclusively for the purpose of carrying out the promotion. The legal basis for this is Art. 6 para. 1 lit. b) GDPR. The Organizer deletes the personal data collected within the scope of the promotion - with the exception of the email address for newsletter dispatch - six months after the conclusion of the promotion, unless another legal basis entitles to further storage. For the personal data of the winner, longer retention periods may apply, e.g., according to § 257 HGB, § 147 AO.

Note: By providing your email address when registering to participate in the promotion, you agree to receive newsletters from the Organizer. You have the right to withdraw your consent at any time without giving reasons, with effect for the future. The withdrawal of consent does not affect the lawfulness of the newsletter dispatch to your email address that took place based on your prior consent. You can declare your withdrawal by email to [...] or by clicking on the corresponding link at the end of each newsletter. After withdrawal, your email address will be deleted, unless another legal basis entitles us to further storage.

The processing of personal data for the purpose of carrying out the promotion particularly entitles the Organizer to

· store and process personal data for the purpose of determining the winner, notifying the winner, and handing over the prize;

• within the scope of reporting on the promotion, the prize drawing, and the prize handover on its own website at [www.kartoffelgefluester.de] as well as on the Organizer's social media channels (e.g., Instagram, TikTok, Facebook, YouTube) to publish the winner's name and, if applicable, photos.

b) Cooperation with the Organizer

In the event of winning, the participant declares their willingness to

· respond to interview requests from the Organizer or media in connection with the promotion,

· participate in the production of image and film material (e.g., public prize handover, photo shoot; interview) and

· agree to the publication of the created material on the Organizer's website at www.kartoffelgefluester.de and on its social media channels (especially YouTube, TikTok, Instagram, and Facebook) for purposes of corporate communication and marketing

c) Recipients of Data

Personal data will only be passed on to third parties if this is necessary for the implementation of the promotion, including the winner determination and prize handover.

8. Applicable Law

This promotion is subject exclusively to the law of the Federal Republic of Germany. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods and German Private International Law.
